Computer company trademarks rare Vail logo
VA keeps close tabs on its name
By Kristin Kenney Williams A Vail-based computer company is thought to be the first firm in the area other than Vail Associates to acquire a federal trademark with the word 'Vail' in a stylized logo.
"We own the word 'Vail' -- it is federally trademarked and owned by us," VA spokesman Paul Witt said.
But Enis Moran, president of VailSoft Corp., questioned how the ski company could own the name of a town. Last week, VailSoft was granted a federal trademark for its logo -- a first in the Vail Valley,
according to Moran. Witt agreed that was probably true.
Vail was named after engineer Charlie Vail, who blazed the path for Interstate 70 in the early '60s.
The ski company's licensing department routinely searches for businesses that want to use the Vail name or one of its trademarked logos.
"Our only concern is whether the person or company wants to use 'Vail' in a similar line of business that we are in," Witt said. "That would confuse people. Common public use of the word is fine."
VA does license its trademark logos to dozens of people and businesses for an unknown cost.
The process of obtaining the trademark for the VailSoft logo took nearly two years, Moran said. First, there was the paperwork akin to bureaucracy. Second, Moran said his efforts were met with some resistance from VA.
"We did send a letter, not opposing what he's doing, but saying let's talk about what he's doing," Witt explained.
VailSoft develops websites for the Internet and custom software applications for businesses, with clients in Vail, New York and Atlanta. Locally, information on Vail, bus schedules, lodging and the Colorado Ski Museum can be found
by clicking onto http://www.vailsoft.com.
When we applied for the trademark, we did not consider any kind of conflicts with VA" Moran said. "We're doing completely different things. I'm not running chairlifts, I'm writing software. We're a software company that happens to be in Vail."
During the long and arduous process of applying for a trademark, Moran said the ski company asked to meet with him.
"We had a talk and their main concern was basically that they felt the word 'Vail' meant them, period," said Moran, who also sits on the Colorado Ski Museum's board of directors. "That people might think that we are Vail Associates."
Moran said he told VA officials that he had no intention of portraying his company as the ski company, and that while they may own the mountain, they don't own the name of the town.
In the end, it all worked out, Moran said.
